Terms of Use
Version: 10 October 2026
These terms apply to the Migradar app, the website migradar.nl, a Migradar account and Migradar Premium (together: "the service"). They are the agreement between you and us. How we handle your data is set out in the privacy policy. These terms exist in English and Dutch; article 1.4 says which text prevails.
1. Who we are and who these terms apply to
1.1 Provider. The service is provided by:
Migradar, established in the Netherlands
Email: support@migradar.com
Website: migradar.nl
You can reach us by email; we usually respond within two working days.
1.2 When they apply. These terms apply as soon as you use the app or the website. By creating an account or buying Premium you agree to them; a link to these terms is shown in the app when you do. You can always read, save and print them on this page. We will send you earlier versions on request.
1.3 Consumer or business. If you use Migradar for yourself, and not for your trade, business or profession, you are a consumer. Anything these terms say applies "to consumers" or "as a consumer" applies only to consumers. If you use Migradar for your trade, business or profession, article 17 also applies, and that article prevails. If you use Migradar partly for your trade, business or profession, and that use is not merely incidental, you are not a consumer.
1.4 Language. The app and these terms are available in English and Dutch. Both versions are authentic. In case of any difference, the version in the language in which you use the app or the website prevails; if you use both languages, the English version prevails.
2. What Migradar is
2.1 The service. Migradar forecasts bird migration over Europe from weather radar data and weather forecasts, shows measured migration on a map, and shows which species are usually on the move in a given period.
2.2 Where the numbers come from.
- The forecast is calculated automatically by a statistical model trained on past radar nights. An individual forecast is not checked by a person before you see it.
- The map shows measurements from weather radars. Between the radars the map is an estimate. On warm, calm nights the radar may also detect insects.
- Species information comes from observations that others have reported to GBIF, not from the radar. Photos and sounds come from Wikimedia Commons.
2.3 Dependent on sources. Migradar uses data from others, mainly radar data from national meteorological services (through EUMETNET OPERA) and the NOAA weather forecast. How many radars and areas take part, and how often the map is updated, depends on what those sources deliver. Figures we mention, such as "45 weather radars" or "updated every fifteen minutes", describe how the service normally works and can vary from night to night. We do not check data from others for content, and we do not guarantee that it is correct, complete or on time.
3. What you can expect from the forecasts
3.1 Estimates, not certainty. A forecast can be wrong, and the map and species information can differ from what is actually flying. We do not promise that a forecast will come true, nor that the information is complete or free of errors.
3.2 What we do promise. We calculate and publish the forecasts with care, in the way explained in the app, and we correct errors we discover within a reasonable time.
3.3 Your own decisions. Whether you go out, travel, stay somewhere overnight, take time off or buy something is your own decision. A forecast that does not come true is not a failure on our part.
3.4 No advice. Migradar does not give professional, ecological, legal or any other advice. Forecasts, maps and species information are information for enthusiasts.
4. Not for safety or business decisions
Migradar is made for birdwatchers and nature lovers. Do not use Migradar as the basis for decisions where safety, health, the environment or significant amounts of money are at stake, not even as one of several aids. This applies, among other things, to:
- aviation, flying drones and preventing bird strikes;
- curtailing or controlling wind turbines and other installations;
- permit applications, environmental impact assessments, ecological advice, research and other products that others rely on;
- planning hunting, trapping or other acts that disturb or harm birds.
If you do so anyway, it is at your own risk; see article 15.2.
5. Age
Anyone may use the app. For an account and for buying Premium you must be 16 or older, or have the permission of a parent or guardian.
6. Your account
6.1 What it is for. You don't need an account: the forecast, the map, the species and the notifications (called "Alerts" in the app) work without one, and you can also buy Premium without one. With an account, Premium belongs to your email address and applies on every device you sign in on. You create an account with an email address and password.
6.2 Looking after your account. Use an email address that is yours, and a password that you do not use anywhere else and keep secret. An account is for one person; you may not give it to someone else. If you suspect someone else is using your account, change your password and let us know.
6.3 Deleting. You can delete your account at any time in the app (Settings › Account › Delete account) or through this page. This does not stop a subscription; see article 8.4.
6.4 Dormant accounts. An account that has not been used for three years and has no running subscription is deleted automatically.
6.5 What your account contains. Your account only contains your email address and, if you have Premium, until when it applies. We handle these with care, but cannot guarantee that they will never be lost. If that happens, you create a new account. You do not lose Premium you bought: it is recorded with Apple or Google, and you restore it with "Restore" in the app.
7. Free and Premium
7.1 Free. The app is free to use. For free you get, among other things, the forecast for three nights, 24 hours of history on the map, and a notification on exceptional nights.
7.2 Premium. Migradar Premium is a subscription that adds more: the forecast for all seven nights, seven days of history on the map, and notifications at any level, for the night and the morning. Exactly what Premium includes is shown in the app before you buy.
7.3 The free version. We may adjust, extend or limit the features of the free version.
7.4 Premium without payment. If we give you Premium without you paying for it, it is linked to your account and applies for the period we tell you. No subscription comes with it: you pay nothing, it does not renew automatically, and we may end it earlier. Article 8 does not apply to it.
8. Subscriptions
8.1 Buying and paying. You buy Premium in the app, through the App Store (Apple) or Google Play (Google). Apple or Google handles the payment, under their own terms, and charges the amount to your Apple ID or Google account. The price, the term (one month or one year) and what Premium includes are shown in the app before you confirm. The price shown by the store includes VAT.
8.2 Renewal. The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the period. On the App Store the renewal is charged within those last 24 hours; on Google Play around the renewal date.
8.3 Cancelling. You can cancel at any time, in the subscription settings of the App Store or Google Play. You keep Premium until the end of the period you have already paid for.
8.4 Deleting is not cancelling. If you delete the app or your account, the subscription keeps running until you cancel it in the App Store or Google Play.
8.5 Cooling-off period. As a consumer, you can withdraw from a purchase of Premium within 14 days of the day of purchase, without giving a reason. You do this with Apple or Google, because that is where you paid: with Apple at reportaproblem.apple.com, with Google through Google Play. If you have already used Premium during those 14 days, the terms of Apple or Google, which apply to the purchase, decide what that means for your refund. If you cannot withdraw with Apple or Google, you can also do it with us: email support@migradar.com with "Withdrawal" in the subject and state your purchase (date and subscription). We confirm your withdrawal by email as soon as we have received it.
8.6 Refunds. Refunds go through Apple or Google, under their terms; on the App Store only Apple can issue refunds. Whether and how much you get back is decided by Apple or Google, and in a dispute ultimately by the court.
8.7 Restoring. On a new device with the same Apple ID or Google account, you restore Premium with "Restore" in the app. With an account, Premium also applies on your other devices.
8.8 Price changes. We may change the price of Premium. A higher price only applies from the first renewal after Apple or Google has informed you of it. If the store asks for your consent, your subscription only renews if you give it. You can always cancel before the renewal.
8.9 Changes to Premium. We may change Premium if there is a good reason: a source changes or disappears, we improve or secure the service, or the law or the rules of Apple or Google require it. This costs you nothing extra. If a change limits what you can do with Premium to more than a minor extent, we will tell you at least 30 days in advance, or as soon as possible if the cause lies outside our control. You may then end the subscription free of charge up to 30 days after the change, or after our message if that comes later.
8.10 Ending Premium or Migradar. We may end Premium or the whole service. We will tell you at least 30 days in advance.
9. Availability, maintenance and outages
9.1 No guaranteed availability. We do our best to keep Migradar working well and without interruption, but we do not guarantee that the service is always available and free of errors.
9.2 Maintenance and updates. Maintenance, updates and improvements may make Migradar temporarily unavailable or limited, and features may change. An older version of the app may stop working, so install updates. If something does not work because you did not install an available update, that is not a failure on our part.
9.3 If Premium does not work as described. If Premium does not do what the app describes, and this is not caused by you or your device, let us know. We will make it work again within a reasonable time. If that fails or takes too long, you may, as a consumer, end the subscription. Maintenance (article 9.2) and a short, incidental outage do not fall under this.
9.4 Force majeure. We are not liable for damage caused by circumstances beyond our control that we could not reasonably have prevented, such as radar data or weather forecasts ceasing or changing; an outage at our hosting, email or push service, at Apple or Google, or of the internet or power supply; and an attack on our systems despite appropriate security. Your rights under article 9.3 remain.
10. Notifications
10.1 How they work. In the app, notifications are called "Alerts". If notifications are on, we send you one message on an evening when the forecast reaches your threshold. You set the threshold yourself. You don't need an account for this.
10.2 No guarantee of delivery. A notification follows the forecast and can therefore also be wrong. Notifications go through Expo and the notification services of Apple and Google, and depend on your device's settings and connection. We do not guarantee that a notification always arrives, arrives on time or arrives exactly once. If in doubt, check the app.
11. What you may not do
11.1 Not allowed. You may not:
- use a bot, script or other program to read Migradar automatically or download data in large quantities (scraping), or use Migradar's server outside the app and the website, without our written permission;
- use Migradar in a way that disrupts, overloads or damages the service;
- use Migradar to circumvent security, access restrictions or the line between free and Premium;
- use Migradar to resell, publish or include forecasts, maps or other Migradar data in a product or service of your own, without our written permission;
- disassemble, decompile or copy the app, except for studying how it works and decompiling for interoperability with other programs as permitted by articles 45l and 45m of the Dutch Copyright Act;
- use Migradar with an account in someone else's name or with an email address that is not yours;
- use Migradar in breach of the law or the rights of others.
11.2 What is allowed. You may share a screenshot of Migradar with others or on social media, as long as it is not commercial and you name Migradar as the source.
11.3 Damage from a breach. If you breach this article and we suffer damage as a result, you are liable for it.
12. Measures against misuse
12.1 When. We may limit your access to Migradar, temporarily block or delete your account, or refuse requests from your device or network, if:
- you breach these terms, in particular article 11;
- there is fraud, misuse or unlawful use, or a well-founded suspicion of it;
- this is necessary to protect the security or operation of the service or the data of others;
- a court or a supervisory authority requires it of us.
12.2 Proportionate and explained. We choose a measure that fits the seriousness of the situation. A block based on a suspicion is temporary, until we have looked into it. We will tell you in advance which measure we take and why. If urgency or security does not allow this, we will tell you as soon as possible afterwards. If you disagree, email us and we will look at it again.
12.3 Premium. If we end your access to Premium, you cancel the subscription yourself in the App Store or Google Play.
12.4 After termination. After your account is deleted, we erase your account data as described in the privacy policy. If we end your access for a reason in article 12.1, your right of use under article 13.2 also ends. Articles 11.3, 13, 15, 17, 21 and 22 continue to apply after termination.
13. Intellectual property
13.1 Ours. The app, the software and source code, the Migradar name and logo, the design, the texts, the forecasts, maps and other data we create, the databases behind them and the documentation belong to us or our licensors. You do not acquire ownership of them or any rights other than those in this article.
13.2 What you may do. You get a personal, non-exclusive and non-transferable right to use the app and the website for your own use, as intended. You may not pass this right on to others. What you may not do is set out in article 11.
13.3 Material from others. Migradar uses data and material from others, under their licences. Those licences apply to that material; the credit for each photo and sound is shown in the app.
| Source | What | Licence |
|---|---|---|
| EUMETNET OPERA Open Radar Data, from the national meteorological services | Radar data | CC BY 4.0 |
| vol2bird (ENRAM) | Software that extracts birds from radar data | Open source |
| NOAA GFS | Weather forecast | Public domain |
| GBIF.org | Bird observations | CC0 and CC BY 4.0 |
| Wikimedia Commons | Bird photos and sound recordings | Stated per file in the app (including CC BY and CC BY-SA) |
| Natural Earth | Map shapes | Public domain |
| GeoNames | Place names | CC BY 4.0 |
We process this material. We convert radar data into bird densities with vol2bird and estimate it between the radars, we process weather data into a forecast, and we summarise observations into calendars and migration routes. What you see in Migradar is therefore not the original material and has not been checked by the source holders. Each map carries a credit in the app, and under Settings › About Migradar › Open-source licences you can see which open-source software we use.
13.4 If your rights are infringed. If you believe something in Migradar infringes your rights, for example a photo or sound without proper credit, email support@migradar.com with "Rights" in the subject. We will look at your report promptly, and change or remove the material if you are right.
13.5 Your ideas. If you send us suggestions or ideas, we may use them freely and without payment.
13.6 No affiliation with source holders and stores. Migradar is not affiliated with, and is not endorsed or approved by, EUMETNET, the national meteorological services, NOAA, GBIF, Wikimedia, Apple or Google. Their names and marks belong to them and appear here only to state where data comes from or which store is meant.
13.7 References to others. The app and the website sometimes refer to sites and services of others, such as the page of a photo or sound. Their terms apply there; we are not responsible for their content.
14. Your own responsibility
14.1 What for. You are responsible for:
- a device with at least the version of iOS or Android stated in the store listing, and an internet connection; the cost of your data usage is yours;
- your device's settings, such as those for notifications and location;
- installing updates of the app;
- the accuracy of what you enter, such as your email address and your place;
- the decisions you make based on Migradar;
- your safety when out and about, and complying with rules, such as traffic rules and rules that protect nature areas and birds. Do not use the app while driving.
14.2 Respect for birds and nature. Use Migradar with care for birds and their habitat. Do not disturb nesting, resting or roosting birds, and do not go near nests or roosts. Do not play the recordings in the app to lure birds or provoke a response, especially not for protected or scarce species or in nature reserves. Follow the rules of the area you are in, such as access and disturbance restrictions.
15. Liability
15.1 What is not a failure. We are not in breach if:
- a forecast does not come true, or the map, the species information or a notification differs from what was actually flying;
- the service is temporarily unavailable or limited because of maintenance, an update or force majeure (article 9.4);
- a notification arrives late, not at all or more than once because of a cause at Expo, Apple, Google or your device;
- something does not work because of your device, your connection, your settings or an update you did not install.
15.2 Costs based on Migradar. We do not compensate costs you incur because you rely on a forecast, the map or a notification, such as travel and accommodation costs, days off or purchases, nor the consequences of a missed or disappointing sighting. The same applies to damage from use for which Migradar is not intended (article 4).
15.3 No compensation. In other cases too, we do not compensate damage arising from the use of Migradar or from being unable to use it.
15.4 When these limitations do not apply. Articles 15.2 and 15.3 do not apply:
- in case of intent or gross negligence on the part of Migradar;
- to damage from death or personal injury;
- to liability for a defective product (product liability);
- to a right to compensation under Article 82 of the GDPR.
Your rights under articles 8.9, 8.10 and 9.3 are not limited by this article.
15.5 Reporting damage. Report damage by email as soon as possible, with a description of what happened. We can then help limit the damage and prevent it from happening again.
16. Privacy
How we handle personal data is set out in the privacy policy. That policy informs you about our processing; it is not part of these terms.
17. Business use
17.1 When. This article applies if you use Migradar for your trade, business or profession, for example as a guide, travel organiser, consultancy or research institution. It prevails over the other articles.
17.2 Use. You may use Migradar within your organisation to orient and plan your own work. You do not use forecasts, maps or other Migradar data as the basis for advice, reports, permit applications, products or services for others, and you do not pass them on to others, unless we have agreed to this in writing.
17.3 Liability. Instead of articles 15.3 and 15.4, the following applies:
- We are not liable for damage of any kind, including direct and indirect damage, consequential damage, loss of profit, loss of revenue, lost savings, loss of or damage to data, damage to goodwill or reputation, business interruption, fines, and damage from claims by third parties, such as your customers.
- This exclusion and article 15.2 do not apply in case of intent or deliberate recklessness on the part of Migradar, nor to damage from death or personal injury.
- Report a claim for damages by email within 30 days after you discovered or could reasonably have discovered the damage. A claim lapses twelve months after the event that caused the damage, unless you have started proceedings within that period.
- This exclusion also applies to the persons and companies we engage for the service; they can invoke them themselves.
17.4 Indemnity. You indemnify us against claims by third parties, including your customers, clients and supervisory authorities, arising from:
- your use of Migradar in breach of these terms;
- the use of Migradar data in your advice, reports, products, services or decisions for others;
- a breach of the law or of the rights of others by you.
You compensate the damage and the reasonable costs of defence that result for us. We will tell you as soon as possible if a third party makes a claim against us, and consult you about the defence. The indemnity does not apply if the claim results from intent or deliberate recklessness on the part of Migradar.
17.5 No consumer provisions. What these terms say applies only to consumers, including articles 8.5, 9.3 and 21.2, does not apply to you.
17.6 Law and court. The agreement between you and us is governed by Dutch law. Disputes will be submitted exclusively to the Amsterdam District Court (rechtbank Amsterdam).
17.7 Your own terms and earlier agreements. Your own general terms and conditions, such as purchasing terms, do not apply. These terms replace earlier agreements and statements about Migradar between you and us, unless we have agreed otherwise in writing.
18. If you got the app from the App Store
For the app you obtained through Apple's App Store, the following also applies:
- Parties. These terms are an agreement between you and us, not with Apple. We, not Apple, are responsible for the app and its content.
- Licence. Your right to use the app is non-transferable and applies to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts associated with the purchaser via Family Sharing or volume purchasing may also use the app.
- Maintenance and support. We are responsible for maintenance and support of the app, as described in these terms. Apple has no obligation whatsoever to furnish any maintenance or support.
- Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (the app itself is free). Apple has no other warranty obligation with respect to the app. Any other claims, losses, costs and damages attributable to a failure to conform to a warranty are ours and not Apple's, subject to articles 15 and 17.
- Claims. We, not Apple, are responsible for addressing any claims by you or others relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual property. If anyone claims that the app or your possession or use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Contact. Questions, complaints or claims about the app should be directed to us, using the details in article 1.1.
- Third-party terms. When using the app you must comply with applicable third-party terms, such as those of your mobile network provider.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Upon your acceptance, Apple has the right to enforce these terms against you as a third-party beneficiary.
19. If you got the app from Google Play
For the app you obtained through Google Play, the Google Play Terms of Service also apply. Google is not a party to these terms and is not responsible for the app.
20. Changes to these terms
20.1 When. We may change these terms if there is a good reason: a change in the service or in Premium, in the law or case law, or in the rules of Apple or Google, or to counter misuse or security problems.
20.2 How. We announce a change that is to your disadvantage at least 30 days in advance in the app, by email if you have an account, and on the website. For a running Premium subscription, such a change only applies from the first renewal after those 30 days. If you do not agree, you can stop using Migradar, delete your account and cancel your subscription before that renewal. A change that is not to your disadvantage, or that a new law requires of us, may take effect sooner.
21. Law, complaints and disputes
21.1 Complaints. If you have a complaint, please email us first at support@migradar.com. We will confirm your complaint as soon as possible and try to resolve it together with you within 14 days. If we cannot resolve it together, you can bring your dispute as set out in article 21.2 (consumers) or 17.6 (business).
21.2 Consumers. These terms and your use of Migradar are governed by Dutch law. If you live in another country, you also keep the protection of the rules of that country that cannot be derogated from to the detriment of consumers. You can bring a dispute before the court of your place of residence or the Amsterdam District Court. We can only bring a dispute before the court of your place of residence.
21.3 Business. For business use, article 17.6 applies.
22. Other provisions
22.1 Invalid provision. If a provision is invalid or is annulled, the other provisions remain in force.
22.2 No waiver. Not exercising a right immediately does not mean we waive it.
22.3 Transfer. We may transfer the agreement with you to a party that takes over Migradar or the service. We will tell you in advance. If you do not agree, you can delete your account and cancel your subscription. You may not transfer your rights and obligations under this agreement to someone else.
22.4 Messages. We send messages to you at your account's email address, or show them in the app or on the website. Send messages to us to support@migradar.com.
